Is Your Unclaimed Property Letter a Scam?

If you received a letter from a company informing you that the State of Florida is holding thousands of dollars of your money, it is easy to understand why you would think it might be a scam. While it may sound too good to be true, there is a good chance that you are actually entitled to claim some money or other property. Here are  three tips to protect yourself if you have received an unclaimed property letter and you are unsure what to do.

1) Make Sure the Company is Appropriately Licensed

If the State of Florida, all unclaimed property locator companies must be registered with the Florida Department of Financial Services. In addition, the company must also be licensed in one of the following professions: 1) Private Investigator, 2) Certified Public Accountant (CPA), or 3) Attorney. You may wish to check the company’s license with the corresponding licensing agency. Below are links you can use to verify licenses.

Private Investigators are licensed by the Florida Department of Agriculture and Consumer Services. Check their licenses here:

Certified Public Accounts are licensed by the Florida Department of Business and Professional Licensing. Check their licenses here:

Attorneys are licensed by the Florida Bar. Check their licenses here:

2) Don’t Pay Any Money Upfront

Disposition of Florida unclaimed property is governed by Chapter 717, Florida Statutes. Ch. 717 specifically limits fees to 20% of total property value unless “full disclosure” is provided, and fees shall only be payable to the locator if the claim is approved. Therefore, if a company is asking you to pay money upfront and out of your pocket for their services, there is a good chance it is a scam.
